Difficulties of splitting the assets during divorce process in NJ

How often have you heard people talk about a divorce and exclaim “it’s all about the money!”. The arguments, disagreements and even hostility sometimes just comes down to one thing: Finances.

In New Jersey, after a Divorce Complaint is filed, the Court wants to see a Case Information Statement (CIS) follow closely thereafter. It gives us an idea about the financial health of the marriage. New Jersey Court Rules 1:38-3(d)(1) and 5:5-2(f) require parties to submit a complete CIS early in the divorce process.

Why? Because the Case Information Statement is the financial snapshot of the marriage. It represents all the income, where this income is spent, and tells us about the net worth by subtracting the liabilities from the assets in a marriage. It helps me - your attorney - to zealously advocate on your behalf because now I know your needs and financial requirements. It separates the types of assets and liabilities into individual and joint, which is also very helpful for your divorce attorney. You don’t want to end up being responsible for your ex-spouses’ debts, without even knowing it!

Your Divorce Attorney

Divorce is overwhelming and getting the right divorce attorney is essential through the process. The CIS can be something you don’t want to look at or deal with. It’s detailed, boring and has multiple probing questions. When you’re in the middle of a divorce, the last thing you want in your life is a complex series of financial questions that leave you feeling anxious and uncertain.

Here’s a link to the Case Information Statement required by the Courts in New Jersey:

The simple advice to you is: Don’t let the CIS overwhelm you.
